GENERAL TERMS AND CONDITIONS OF SUBSCRIPTION TO MISS TWEED
The present general terms and conditions specify the contractual relationship between the publishing company Miss Tweed Publishing (hereinafter referred to indifferently as "the site" or Miss Tweed and its readers. Miss Tweed Publishing is a simplified joint stock company (SASU) with a capital of 500 euros, registered under number RCS 842 014 615 and whose address is: 28 rue de Poissy, 75005, Paris, France. Mrs Astrid Jeanne Wendlandt is the sole shareholder of Miss Tweed Publishing.
Operator and scope of application
Miss Tweed is a website that offers online information. The present general conditions govern its relationship with the site's subscribers, subscriptions, access to the content produced by Miss Tweed, as well as all the services offered by the site. All Miss Tweed 's contracts, the details of the different subscription offers, the related rates, the technical characteristics and use of the services offered are permanently accessible on the home page of the site, except in cases of force majeure, breakdown or maintenance operations.
Contracts are presented to each subscriber prior to the first subscription or access offered. This contractual framework applies to all subscribers and users, without condition or reservation. The possible tolerance of a contractual breach of contract does not constitute a waiver by Miss Tweed to take advantage of it. In the event of the nullity of one of the clauses of the contract, the other clauses shall be null and void.
Site access and subscription
Access to the entire content of Miss Tweed is only possible, except for occasional free windows, by subscription. The latter involves filling out a subscription form and then creating a user account and a password that will allow the subscriber to authenticate himself. Username and password are strictly personal to the subscriber. They give her access to editorial content and allow her to renew or modify current contracts with Miss Tweed and to consult her subscription history. The subscriber receives by e-mail the acceptance of his subscription request.
Individual subscription offers allow each user to create a separate user account, with personal access to the service for the duration chosen at the time of subscription and renewable, by tacit agreement, except for fixed-term subscription formulas or termination before the end of the current period according to the terms set out below. Only the Subscription Manager may grant, terminate, suspend or modify the access rights and contact details of users during the subscription period, without de facto extending the conditions of use beyond the duration of the subscription initially taken out. The allocation or suspension of accesses decided upon is the sole responsibility of the subscription manager. In the same way, the main subscriber guarantees the acceptance and respect of these general conditions of sale and use for each of the beneficiary users, under his full and entire responsibility. Each beneficiary is informed by e-mail of the right that the subscription manager has granted him/her. It must confirm its acceptance in accordance with the applicable conditions.
Miss Tweed occasionally proposes promotional offers, some of which are conditional on the entry of a so-called "promo" code. The latter must be entered by the user when subscribing to the offer in order to benefit from it. Information regarding the duration and conditions of these promotional offers is available on the Miss Tweed website.
Due to the unique nature of each promotional offer, if the site finds that a user benefits from an offer that he has already used before, the user may have his access interrupted or even deleted without notice or compensation, and will be invited to take out a subscription offer that he may or may not choose. Miss Tweed reserves the right to modify its offers at any time, or propose other temporary promotional offers, under the conditions detailed on the site.
Evolution of prices
Miss Tweed reserves the right to change its rates at any time, and undertakes to make this known by a publication announcing it on the site during the month preceding the change in rates.
Methods of payment
The payment of the subscription is made according to the rates and terms in force on the Miss Tweed website. The subscription is payable at the time of subscription or, where applicable, renewal. The subscriber is solely responsible for the payment of all sums due under the subscription. A third party may, however, pay the subscription on behalf of the subscriber, without this conferring any special rights on the subscriber.
Method of payment proposed by Miss Tweed
Credit card for monthly or annual subscriptions
Subscription rates for individuals are available on the Miss Tweed website, indicated in euros and are all taxes included (TTC). They do not include the costs of electronic communications and equipment necessary to subscribe to and use the services, which shall be borne by the subscriber. In case of unsuccessful payment by credit card and except in case of theft or opposition, our secure payment provider may be required to represent the payment until its regularization. However, in the event of repeated payment defaults, regardless of the method of payment chosen and after reminders that have remained unsuccessful, the site reserves the right to cancel the current subscription, or even to remove any possibility of subsequent re-subscription for a period of one year from the date of notification of cancellation.
Evolution of subscription
The subscription allows you to consult all the articles published by Miss Tweed. The site may offer new services, free or paying, whose subscription and/or use may be subject to compliance with certain criteria or technical limitations, which will then be specified to the subscriber and/or user.
Rules of use, rights and liability
The creation of a user account does not in itself create rights. It is a declarative procedure allowing you to enter your contact details (title, surname, first name, email etc.). It is up to the user to declare exact contact details and keep them updated in case of modification. On the basis of this information, the account is associated with an "Identifier" and a "Password", chosen by the subscriber and which are strictly personal.
Each user acknowledges and accepts that any use made of Miss Tweed 's services via his account will be deemed to be made under his responsibility, with his agreement, and is strictly personal. The transmission to a third party and the use of these access codes by a third party is strictly forbidden. Failure to comply with this rule will lead to temporary suspension, after an initial warning, or even cancellation of the subscription in the event of a repeat subscription. If the password is forgotten, the subscriber can request its retrieval using the "Forgotten your password? ». In the event of accidental disclosure or theft of the password, the subscriber must replace it as soon as possible, and inform the subscriber service at firstname.lastname@example.org. The subscriber service will proceed, upon request of the subscriber only, to deactivate the usurped access codes. The subscriber will then have to choose a new password, possibly a new login. Failing prompt or immediate action, the account holder will be held responsible for any loss, theft, misappropriation or unauthorized use of his or her access codes and the consequences thereof.
